Rental Terms and Conditions
This English version is provided for convenience. In case of discrepancy, the French version prevails.
These general terms and conditions of rental (the “Terms”) govern the relationship between Soundcall, an audio equipment rental service located at 18 rue des Tennerolles, 92210 Saint-Cloud, France (the “Lessor”), and any person making a booking through the soundcall.fr website or by any other means (the “Renter”).
Any booking implies full and unreserved acceptance of these Terms.
1. Purpose
The purpose of these Terms is to set out the conditions for renting the audio and DJ equipment offered by Soundcall, including in particular: speakers, DJ systems, mixers, accessories and sound system packs.
2. Booking
Bookings are made through the online form on the soundcall.fr website or by direct contact (telephone, email). A booking is confirmed once the online payment has been approved, equipment availability being checked at that moment, and once the Renter has accepted these Terms.
A rental agreement is sent to the Renter electronically. This agreement must be signed and returned before the equipment is picked up.
3. Supporting documents
To complete the booking, the Renter must provide:
- A copy of both sides of a ID document that is currently valid (national identity card or passport)
This document is required to draw up the rental agreement and is processed in accordance with our Privacy Policy (in French).
4. Prices and payment
Prices shown on the website are in euros, inclusive of all taxes (TTC). Rates are given per rental period (24 h or 48 h depending on the product). Any additional day begun is payable in full.
The rental amount is paid online by bank card at the time of booking on soundcall.fr. The order is confirmed only once payment has been approved.
5. Card hold
A card hold (pre-authorisation) is placed online before the rental begins. The amount of the card hold is stated in the rental agreement and varies according to the equipment rented.
The card hold is released once the equipment has been returned in good condition. In the event of damage, loss or late return, the corresponding amount may be taken in part or in full from the card hold.
6. Pickup and return of the equipment
Pickup: the equipment is collected at the Lessor’s address (18 rue des Tennerolles, 92210 Saint-Cloud) or as otherwise agreed (transport by an external provider). A pickup time slot is set by mutual agreement. All equipment is checked and tested in the presence of the Renter before handover.
Return: the equipment must be returned on the agreed date and in the agreed time slot, in the same condition as at pickup. A return inspection is carried out in the presence of the Renter.
The Renter undertakes to return the equipment clean (a basic clean is requested).
7. Pickup and transport
Pickup is free and by appointment at the Saint-Cloud depot, 6 days a week. Soundcall does not transport equipment itself: transport is entrusted to external providers (courier, Uber or Bolt) booked by the Renter. Transport costs are borne by the Renter and paid directly to the chosen provider. Transport arrangements (address, time slot) are agreed between the parties, the provider being booked by the Renter.
8. Renter’s liability
The Renter is responsible for the rented equipment from handover until its return. The Renter undertakes to:
- Use the equipment for its intended purpose and in accordance with the instructions provided
- Not sublet, lend or transfer the equipment to any third party
- Take all necessary measures to prevent damage, theft or loss
- Report any malfunction, damage or loss to Soundcall immediately
In the event of damage, the Renter owes the Lessor, on presentation of supporting documents:
- Repair: the actual cost of the repair (parts and labour), as per the repairer’s quote or invoice;
- Transport and diagnosis: packaging and shipping costs to and from the approved repairer or the manufacturer, and any diagnosis or quotation fees they charge, even if the repair is ultimately not carried out (flat fee of €30 for the round trip when the Lessor handles the drop off and collection itself);
- Loss, theft, destruction, irreparable equipment, missing accessory: the new replacement value of the equipment concerned;
- Downtime excess: when an item goes for repair or has to be replaced, a flat rate indemnity payable once per item, whatever the length of unavailability, based on its 24 h rental price: €25 for a 24 h price up to €25, €75 from €26 to €60, €120 from €61 to €100, €150 above €100. Cosmetic damage that prevents neither operation nor rental does not trigger it. It is not payable when the Damage & Theft Cover has been taken out and the claim is accepted.
These sums are taken from the card hold up to the amount due; any remaining balance is invoiced to the Renter.
9. Cover for rented equipment
The rented equipment is not covered by any policy taken out by Soundcall for the duration of the rental. It is the Renter’s responsibility to check the exact extent of their own cover with their provider. The Renter’s attention is expressly drawn to the fact that home and personal liability policies most often exclude goods that are rented, borrowed or entrusted: an extension of cover or a dedicated temporary policy may be needed to cover theft, breakage and loss of the equipment. Failing this, the Lessor offers the Damage & Theft Cover described in article 9 bis, which covers precisely these situations.
9 bis. Damage & Theft Cover (optional)
The Lessor offers, as an option and without obligation, a Damage & Theft Cover arranged with its partner Tulip. It is not a policy taken out by the Renter : it is a contractual limitation of the Renter’s liability, granted by the Lessor, which alone bears its cost with its partner.
It is chosen at the time of booking, before the equipment is made available, and can never be added once the equipment has left. It does not replace the card hold provided for in article 5, which is placed in all cases.
Price. Only one Cover is payable per order, whatever the number of items. Its price depends on the value, excluding tax, of the equipment actually covered by the order: €7.90 for 24 hours and €13.90 for a weekend package below €1,000; €10.90 and €19.90 from €1,000 to €3,000; €19.90 and €34.90 above €3,000. The exact price is shown before payment and appears on the invoice.
What the Cover pays for: accidental breakage preventing use of the equipment, accidental oxidation, mechanical, electronic or electromechanical failure, irreparable breakage on presentation of a certificate of irreparability, theft involving forced entry and theft with assault.
What remains payable by the Renter: an excess of 10% of the repair cost, with a minimum of €10, or 10% of the value of the equipment in the event of theft, with the same minimum. Depreciation applies from the twenty fifth month of the equipment’s age, capped at 50%. The transport and diagnosis costs in article 8 remain payable by the Renter on presentation of supporting documents; the downtime excess in article 8 is not payable when the claim is accepted.
Excluded equipment. The Pioneer XDJ-XZ all-in-one DJ system is not covered under any circumstances, as stated on its product page. The Pioneer XDJ-RX3 all-in-one DJ system is covered, except when the order states that the XDJ-RX3 is not covered: another unit, without cover, is then handed over. When a pack contains a DJ system that is not covered, the Cover applies only to the rest of the equipment (speakers, mixer, cabling and lighting) and its price is reduced accordingly. Non fixed accessories are also excluded: speaker stands, microphone stands, headphones, cables and wired microphones, cartridges, fog fluid, furniture. The Cover is not offered when the value, excluding tax, of the covered equipment is below €200.
Excluded situations. Theft through negligence, in particular equipment left unattended or visible in an unlocked vehicle; normal wear and tear; cosmetic damage that does not prevent operation; intentional damage; loss and disappearance without proof of theft; failure to return the equipment when due, which remains fully governed by articles 7 and 8.
Notification, on pain of forfeiture. The Renter informs the Lessor within 2 days in the event of theft and within 5 days in the event of breakage. In the event of theft, the Renter files a police report and sends the complete report; in the event of breakage, the Renter sends three photographs of the equipment. Failing this, the Cover cannot be invoked and article 8 applies in full.
Where the Cover is not taken out. The Renter remains fully liable for the equipment entrusted. In the event of breakage, the Renter owes the full cost of the repair, the transport and diagnosis costs and the downtime excess in article 8; in the event of theft or destruction, the replacement value of the equipment and the downtime excess. The card hold is used up to the amount due, and its amount does not limit the Lessor’s claim.
To process a claim, the Lessor sends Tulip only the data required: the Renter’s identity, the rental agreement, a description of the incident and supporting documents. This transfer is described in article 14.
10. Cancellation
The Renter may cancel the booking free of charge if the cancellation is made at least 48 hours before the scheduled pickup time slot.
If the booking is cancelled the day before the pickup time slot (less than 48 hours before), the Renter is refunded 50% of the rental amount.
If the booking is cancelled on the day of pickup, or in the event of a no-show, no refund is due and Soundcall reserves the right to charge the full rental amount.
Cancellation by Soundcall. If Soundcall is unable to provide the equipment booked, the Renter is informed without delay and offered replacement equipment with at least equivalent specifications, at no extra cost. If the Renter does not agree, all sums paid are refunded within seven days.
11. Late return
The equipment is returned on the agreed return day, before the return time agreed with the Lessor; if no time has been agreed, before 1 pm, and on Saturdays between 10 am and 11 am (deadline 11 am). When the equipment goes out to another customer the same day, it must be returned before 11 am, at the time given by the Lessor. The time given by the Lessor prevails. The rental is counted in rental days, not in hours elapsed since pickup. Any change to the return time requires the Lessor’s written consent and is no longer possible when the equipment goes out to another customer the same day. A delay by the courier, ride hailing driver or any other carrier chosen by the Renter counts as a delay by the Renter.
Any overrun of the deadline automatically incurs the following penalties, counted from the deadline:
- Up to 15 minutes late: no penalty.
- From 15 minutes to 1 hour: flat fee of €20.
- From 1 hour to 3 hours: half a day’s rental, with a minimum of €40.
- Over 3 hours, or return on another day: one full rental day for each day of delay begun.
- If the delay prevents the next customer from being served: in addition, the amount refunded or paid in compensation to that customer, on presentation of proof.
These sums are taken from the card hold up to the amount due; any remaining balance is invoiced to the Renter. After 48 hours without contact, the Lessor reserves the right to file a police report and to report the equipment as stolen; after 7 days, the new replacement value of the equipment is due. Details are set out in article 2 of the rental agreement.
12. Force majeure
Neither party shall be held liable for failure to perform its obligations in the event of force majeure as defined by article 1218 of the French Civil Code (natural disaster, pandemic, government measures, etc.).
13. Right of withdrawal
In accordance with article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services that must be provided on a specific date or during a specific period. Making sound, lighting and DJ equipment available for an event whose date is fixed at the time of booking falls within this exception: a consumer Renter therefore has no right of withdrawal, and only the cancellation terms in article 10 apply.
14. Data protection
Personal data collected in connection with the rental is processed in accordance with our Privacy Policy (in French).
15. Disputes
These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before taking any legal action.
In accordance with articles L611-1 et seq. of the French Consumer Code, a consumer Renter is entitled to use a consumer mediator free of charge with a view to the amicable resolution of any dispute, under the conditions set out in article 15 bis.
A consumer Renter may bring proceedings, at their choice, before the court for the place where they lived when the contract was concluded, the court for the place where the harmful event occurred, or any court with territorial jurisdiction under the French Code of Civil Procedure. For business Renters, exclusive jurisdiction is given to the courts for the area of the Lessor’s registered office.
15 bis. Consumer mediation
Before referring the matter to the mediator, a consumer Renter first sends a written complaint to Soundcall (by email or by post). If the dispute is not resolved within two months, or if no reply is received, the Renter may refer it free of charge to the consumer mediator named below, within one year of the written complaint.
Consumer mediator: details to be added
16. Changes to the Terms
Soundcall reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date of booking.
